Juvenile Restraining Order

ALL DOCUMENTS SUBMITTED TO THE COURT SHOULD BE SUBMITTED IN DUPLICATE.  The Court will keep and file one set of copies.  If you would like the Juvenile Clerk of Court's office to make additional copies for you, the cost will be $1.25 per page.

CHILD ABUSE

This type of restraining order is heard in Juvenile Court if the alleged child victim is under the protection and services of Juvenile Court, OR the respondent (person from whom protection is being sought) is 17 years of age or younger. 

The child victim or a parent, step-parent, or legal guardian of the child victim may be a petitioner under this section.

SERVICE: The petitioner is responsible for service and/or notice.  For additional information please consult Wisconsin Statute 813.122.  The Waukesha County Sheriff Dept. will serve the respondent without cost as a courtesy if they reside in Waukesha County.  (This policy is subject to change at any time by the Sheriff Department.)  If the petitioner chooses to have the documents in the action served by the sheriff, the petitioner should contact the sheriff to verify the proof of service of the petition (Waukesha County Sheriff Department (262)-548-7151).  The petitioner may, at their own expense, elect to use a private server to effect service.

GUARDIAN AD LITEM: The child to be protected and/or the respondent child will be appointed a guardian ad litem by the court, unless they wish to retain private counsel.  The parent(s) of the child is/are obligated to pay these costs.
