Right to an Attorney
If you have been charged with a crime, you have the right to an attorney. If you cannot afford to hire an attorney, you may apply to the State Public Defenders Office, or one may be appointed to you.

State Public Defender will not automatically represent you. You must go to their office and complete a financial application. They will review your financial situation and determine if you are eligible for their service. Failure to bring the following information with with you when you apply may result in a delay of attorney appointment:
- Your Criminal Complaint and notice of your next court date;
- Social Security number;
- Medical Assistance card or other records to verify your grant if you receive any of the following:
- AFDC
- RNIP
- General Assistance
- SSI or SSIE
- Copy of your check stub or a statement of earnings if you have any other source of income such as the following:
- Employment
- Unemployment Benefits
- Workers Compensation
- SSDI
- Social Security Benefits
- Names of banks at which you have any of the following:
- Accounts
- Trusts
- Stocks
- Bonds
- Retirement/Pension funds
- If you own or are buying any real estate or vehicles, documentation of the value of the property and the name of the lending institution or any pending loans or mortgages.
- Proof of any of the following expenses you claim:
- Child support payments
- Outstanding fine and forfeitures
- Restitution
- Chapter 11 or 13 payments
- Child care (work related only)
- Health insurance payments
- Utility arrearages (no phone/cable)
- Huber jail charges
- Income taxes owed
- Medical/dental/social services bills
- Outstanding civil judgment
- Rent/mortgage arrearages
- Student loan payments
- High-risk auto insurance
