Contempt/Enforcing an Order
Once the divorce, legal separation, or final judgment of paternity has been granted, and a party is not following or doing what is required by the court order, parties may make the court aware of the situation. They do this by filing for Contempt. There are two types of Contempt. The type used depends on which part of the order a party is suspected of not following.
Enforcing a Physical Placement Order
You may use this packet if you believe that
- the other parent has denied your specific time of physical placement or not returned the child as required, or
- interfered with your physical placement (visitation), or
- if you have incurred a financial loss or expense as a result of the other parent's failure to exercise placement.
This packet is used only to enforce the current physical placement order and ensures that you will get into court within thirty (30) days. If you would like to change the court ordered legal custody or physical placement schedule that is currently in place, you may do so by also using the Motion to Modify Forms Packet.
The party making the claim of contempt is also required to properly notify the other party of the court date and provide proof of Service.
If filing a Motion to Enforce Physical Placement Order in paper format, please provide five (5) copies of each document.
Contempt
This packet is used to enforce all other portions of court orders or judgments except physical placement of a child. This packet is used only to enforce orders that have already been approved by court. If you would like to change a portion of an order, you may do so by using the Motion to Modify Forms Packet.
If filing an Order to Show Cause or Affidavit for Contempt in paper format, please provide five (5) copies of each document.
