Modify a Court Order

If the parties agree to changes on an existing order, they may complete and file the Stipulation to Change Forms Packet.  If filing a Stipulation in paper format, please provide two (2) copies of the proposed Stipulation to Change with stamped envelopes addressed to both parties.

If the parties cannot agree to making modifications to an existing Order, one of the parties may file a Notice of Motion and Motion to Change requesting that the Court make a decision as to whether the changes they have requested will be granted by the Court.  They must properly serve the other party with the Notice of Motion and Motion in the Modification Forms Packet below.  The court must receive proof of property service prior to the hearing.  If filing a Motion to Modify in paper format, please provide five (5) copies of each document.

Warning: Without proof of service, the court cannot proceed with the hearing.

The party filing the motion should be prepared to pay any and all Family Court Filing Fees, unless a Waiver of Fees has been granted.
