Grandparent/Stepparent Visitation
Visitation by a Child's Grandparents and Stepparents §48.9795(12)

Requirements for Grandparents:
- You are the legal grandparent of the child you wish to have visitation with.
- Your child (one of the legal parents of the child) is deceased.
Requirements for Stepparents:
- You were/are the legal stepparent of the child you wish to have visitation with.
- Your spouse who was the legal parent of the child is deceased.
A petition for visitation and GF-150 Uniform Child Custody Jurisdiction and Enforcement Act Affidavit, along with a $60.00 filing fee is required to initiate this action. You can do this utilizing the eFiling system, or in person at the Juvenile Clerk of Courts Office (521 Riverview Ave., Waukesha, WI 53188) during business hours.
SERVICE: The petitioner is responsible for service and/or notice. For additional information, please consult Wisconsin Statute 48.9795(4)(c) Service of Petition and notice. An Affidavit of Service or Certificate of Service must be filed with the court no later than 96 hours prior to the hearing.
GUARDIAN AD LITEM: Pursuant to Wisconsin Statute 48.9795(3)(a) the court shall appoint a guardian ad litem when a petition is filed for appointment of a guardian. In accordance to Wisconsin Statute 48.235(8)(b) the court may order either or both parties to pay all or any part of the compensation of the guardian ad litem.
