Emergency Guardianship

Minor Guardianship of a Child: Emergency §48.9795

Petition to the Court to appoint an emergency guardian for a child.

SEPARATE PETITIONS MUST BE FILED IF YOU ARE SEEKING MORE THAN ONE TYPE OF GUARDIANSHIP.

ALL DOCUMENTS SUBMITTED TO THE COURT SHOULD BE SUBMITTED IN DUPLICATE.  The Court will keep and file one set of copies.  If you would like the Juvenile Clerk of Court's office to make additional copies for you, the cost will be $1.25 per page. 

 

SERVICE: The petitioner is responsible for service and/or notice.  For additional information, please consult Wisconsin Statute 48.9795(6)(b)2.

GUARDIAN AD LITEM: Pursuant to Wisconsin Statute 48.9795(3)(a) the court shall appoint a guardian ad litem when a petition is filed for appointment of a guardian.  In accordance to Wisconsin Statute 48.235(8)(b) the court may order either or both parties to pay all or any part of the compensation of the guardian ad litem.

REQUEST TO RECONSIDER OR MODIFY: Pursuant to Wisconsin Statute 48.9795(6)(b)5. If the court appoints an emergency guardian, any person specified in Wisconsin Statute 48.9795(6)(b)2 may petition for reconsideration or modification of the emergency guardianship and the court shall hold a rehearing on the issue of appointment of the emergency guardian within thirty (30) calendar days after the filing of the petition.
