Powers of Attorney
Actions involving Health Care Power of Attorneys are within the exclusive jurisdiction of the Circuit Court Probate Division.
Actions regarding Durable Financial Power of Attorneys are normally under the jurisdiction of the Circuit Court Civil Division, but in Waukesha County any actions initiated regarding durable financial power of attorneys are heard by the Probate Division.
Health care power of attorneys may be filed with the Register in Probate for safekeeping. The procedure and requirements for filing a health care power of attorney for safekeeping are spelled out in the Wisconsin Statutes and supplemented by the Waukesha County Probate Local Rules. Durable financial power of attorneys are NOT accepted by the Register in Probate for safekeeping.
The Register in Probate does NOT maintain or distribute blank copies of either a health care power of attorney or a durable financial power of attorney. If you wish to obtain a healthcare power of attorney and/or a durable financial power of attorney, then you will either have to obtain legal counsel or you can get standard state form copies of these documents at the Wisconsin Department of Health Services website.
